Course Objectives The purpose of this course is to teach the rules on private international law and international civil procedural law that applied by Turkish courts in disputes with foreign element within the scope of the Act #5718, related legislation and international agreements.
Learning Outcomes The students who succeeded in this course;
  • Define the basic concepts of private international law which possess ascending importance in our global world.
  • Explain the connecting points of private international law
  • Compare Continental law and Anglo-American law system regarding fraud of law, conflict of rules and adaptation, preliminary question and renvoi.
  • Evaluate the importance of public order and mandatory rules, acquired rights with respect to our material law.
  • Provide knowledge of international civil procedure law matters, especially international competence, international arbitration, recognition and enforcement of foreign court judgments and arbitration decisions.
Course Description Concept of private international law, sources of private international law, rules of private international law, connecting rules, rules of international civil procedure law.
